Former Director General of police SPS Rathore might have got relief by the decision of Central Administration Tribunal but Ruchika’s Family and friend have been left with a bitter taste in mouth.

In his petition before the CAT Rathore had also compared his case with that of former Punjab DGP K P S Gill, who too was convicted on charges of molestation.

“No order for withholding the pension of KPS Gill who has also been found guilty of molestation. This despite the fact that the conviction of KPS Gill had attained finality on July 27, 2005 by the apex court,” Rathore argued.

The court decided this in favor of Rathore but what it overlooked was that KPS Gill was fighting a battle against a strong powerful women IAS officer but getting justice against Rathore who was senior police officer with a lawyer wife to support was a uphill task.

In a fight between a common man and a police officer with a lawyer wife, SPS rathore has been able to drag the judicial process for 19 long years.. “It has been a long fight although we had a very competent team of lawyers and truth on our side but still they were able to drag the case for this long time “says Anand Prakash.

A division bench of the Central Administrative Tribunal (CAT) headed by Justice S D Anand has ordered the restoration of the pension of Rathore, which was stopped by the Centre in June last year.

69-year-old Rathore was awarded six months’ rigorous imprisonment and fined Rs 1,000 by the Chandigarh CBI court in December 2009 for molesting the 14-year-old tennis player here on August 12, 1990. The girl committed suicide three years later.

“Definitely it is disappointing for me and Family that he has walked away with full pension again but our fight is not over we will get the copy of order soon and then we will challenge the decision in the competent court” said Prakash.

Ruchika`s aunt  Madhu Prakash feels  “It is the failure of the system. Firstly, he got punishment after so long. He enjoyed all the facilities during this time, got promotion and all. I am very disappointed by the CAT decision”.

Rathore in his petition had said “The pension of a person is not a bounty. It is a legal entitlement which can only be curtailed by an express provision of law and not otherwise” and on basis of this plea his pension was restored but bigger question was overlooked that how can a person convicted by court of law for molesting a teenager just get off the hook.
